Welcome to Field General, a platform where users (“Hunters”) connect with hosts (“Landowners”) to schedule and book exclusive access of private hunting land. By using our website, you agree to comply with and be bound by the following terms and conditions.

These Terms and Conditions are a binding legal agreement between you and Field General that govern the intended use of the website. 

1. Introduction

• Field General LLC (“we,” “us,” “our”) is a company registered in Washington State. We provide a platform for landowners to list their private land for rent to hunters.

2. Account Creation

• Hunters must create an account using their name, phone number, and email.
• Landowners must create an account using their name, phone number, email, and property information, such as address, acreage, land features, and species available to hunt.

3. Appropriate Use

• The website is intended for hunters to access private land for rent. Users agree to refrain from using the website for any illegal, harmful, or unauthorized purposes or engage in any activity that violates applicable laws, regulations, or third-party rights.

4. Limitation of Liability

• To the maximum extent permitted by law, Field General shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use our platform; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from our platform; or (iv) any bugs, viruses, or the like that may be transmitted to or through our platform by any third party.

5. Indemnification

• You agree to indemnify and hold Field General, its affiliates, officers, agents, and employees harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.
• Field General is not accountable for any harm, injury, death, or other damages caused by either party while engaged in our service.

6. Modifications and Termination

• We reserve the right to modify or terminate the website and these terms at any time without prior notice. We will update the “last updated” date accordingly.

7. Disputes

• Disputes will be resolved through informal negotiations. If unresolved, disputes will be submitted to arbitration in the United States.

8. Data Collection and Use

• We collect personal information such as name, phone number, email address, usernames, and passwords.
• We collect derivative data and location data from users.
• We use cookies to deliver targeted advertising and evaluate our services.
• We send notifications and marketing communications to users, who can unsubscribe at any time.

9. Third-Party Advertisements

• Our website may contain third-party advertisements, some of which are not affiliated with us.

10. Privacy Policy

• Please review our Privacy Policy for more information on how we handle your personal data.

11. Cancellation and Refund Policy

• Unpaid bookings are automatically terminated after 48 hours.
• Hunters are eligible for a refund as determined by the landowner’s cancellation policy.
• If a landowner cancels, hunters are eligible for a full refund.
• In the event of double booking, Field General will refund each party that attempted to book. 

12. Booking Modifications

• Hunters and landowners are responsible for any booking modifications and any associated fees or taxes.

13. Taxes

• Landowners must report income earned through Field General on their annual taxes.
• We may collect and report tax information as required by law.

14. Fees

• We charge fees and applicable taxes to hunters for each booking.
• Service fees are non-refundable.
• We reserve the right to change service fees without notice before changes become effective.

15. Third-Party Service

Field General LLC is solely acting as a third-party connection between hunters and landowners. We are not responsible for any bodily harm, land damage, unlawful activity, or death while engaged in the use of our service.

User Responsibilities

Field General Landowner Booking Agreement

1. Acceptance of Terms 

• By listing your land for hunting access through Field General, you (“Landowner”) agree to comply with these terms, along with our general Terms of Service and Privacy Policy. Failure to adhere to these terms may result in the termination of your listing or suspension of your account.

2. Landowner Responsibilities

• The Landowner represents and warrants that they are the legal owner of the property or have obtained explicit permission from the legal owner to rent the land for hunting purposes.
• The Landowner is responsible for accurately describing the property, including any hazards, restrictions, or special conditions that may affect the hunter’s safety or experience.
• The Landowner must clearly communicate any known hazards on the property, such as dangerous terrain, bodies of water, hidden obstacles, or potential wildlife threats, to ensure the Hunter is fully informed of possible risks.
• The Landowner must communicate any local, state, or federal hunting regulations that may apply to the property, but they are not responsible for ensuring the Hunter’s compliance.
• The Landowner may impose specific rules regarding access, use of vehicles, camping, and other activities on the property. Landowner has the right to limit access to specific areas of the property.
• The Landowner agrees to meet with the Hunter, via phone or in-person, prior to the visit to discuss expectations of the trip, review property boundaries, and provide any additional details necessary for a safe hunt.

3. Liability and Assumption of Risk

• The Landowner acknowledges that hunting is an inherently dangerous activity and that they are offering access to the land at the Hunter’s own risk.
• Field General is not responsible for any incidents, damages, or losses that occur on the property.
• The Landowner agrees that they are not responsible for any injuries, death, or damages sustained by the Hunter, their guests, or any third parties while on the property, regardless of cause.
• The Landowner waives any right to bring claims, lawsuits, or demands against Field General for any liability arising from a Hunter’s use of the property.
• While not required, the Landowner is encouraged to obtain liability insurance to cover any risks associated with allowing hunting on their property.
• The hunter acknowledges and agrees to assume full responsibility for any damages to the landowner’s property arising from their use of the land. The hunter shall indemnify and reimburse the landowner for any costs associated with the repairs, replacements, or other expenses incurred as a result of such damages.

4. Compliance with Laws

• The Landowner must comply with all local, state, and federal laws regarding land use, hunting access, and property rental.
• Field General is not responsible for verifying the legality of any land listing, and the Landowner assumes all responsibility for compliance.
• The Landowner is not responsible for ensuring that the Hunter follows hunting laws, regulations, or licensing requirements.

5. Indemnification

• The Landowner agrees to indemnify, defend, and hold harmless Field General from any claims, damages, or liabilities arising from the use of their property, including but not limited to injuries, death, property damage, or legal disputes related to hunting access. Indemnification applies to all potential claims, whether they arise from injuries, deaths, damages, or other legal issues linked to the hunting access that has been provided.

6. Payments and Fees

• Landowner agrees to create an account with Stripe, a third-party payment processing service, in order to receive funds from each booking.

7. Cancellations and Refunds

• Unpaid bookings are automatically terminated after 48 hours.
• The Landowner may establish their own cancellation policy within Field General’s platform guidelines.
• The Landowner agrees to honor confirmed bookings unless exceptional circumstances prevent access.

8. Dispute Resolution

• Any disputes arising from this agreement shall first be attempted to be resolved through informal negotiations. If unresolved, disputes will be subject to arbitration as outlined in Field General’s Terms of Service.

9. Acknowledgment

• By listing a property and accepting a booking, the Landowner acknowledges that they have read, understood, and agreed to these terms. The Landowner further agrees that Field General is not liable for any incidents or disputes arising from the use of the property.

Field General Hunting Access Agreement

1. Acceptance of Terms 

• By booking land through Field General, you (“Hunter”) agree to comply with these terms, along with our general Terms of Service and Privacy Policy. Failure to adhere to these terms may result in termination of access, removal of account, and potential legal consequences.

2. Use of Property

• The Hunter is granted temporary, non-exclusive access to the booked land for hunting purposes only.
• The Hunter must comply with all applicable local, state, and federal hunting laws and regulations. Hunter is responsible for understanding and following all local laws that may be specific to the area they are hunting.
• No modifications, structures, or permanent changes may be made to the land.
• The use of vehicles, ATVs, campfires, or any equipment beyond hunting gear is subject to landowner approval.
• The Hunter agrees to carry any required hunting licenses and permits as required by law.

3. Liability and Assumption of Risk

• The Hunter acknowledges that hunting is an inherently dangerous activity that involves significant risks, including but not limited to injury, death, property damage, encounters with wildlife, hazardous terrain, and unpredictable weather conditions.
• The Hunter assumes all risks associated with hunting and entering the property and acknowledges that neither the landowner nor Field General can guarantee their safety.
• The landowner and Field General shall not be liable for any injuries, damages, or losses sustained during the use of the property, regardless of cause, including but not limited to negligence, accidents, or acts of nature.
• The Hunter acknowledges and agrees to assume full responsibility for any damages to the landowner’s property arising from their use of the land. The hunter shall indemnify and reimburse the landowner for any costs associated with the repairs, replacements, or other expenses incurred as a result of such damages.
• The Hunter waives any right to bring claims, lawsuits, or demands against Field General and the landowner for any incidents, injuries, or damages occurring on the property, regardless of cause.
• Field General and the landowner disclaim any warranties, express or implied, regarding the safety, suitability, or condition of the property for hunting activities.
• The Hunter is solely responsible for ensuring compliance with all applicable hunting laws and regulations. Field General and the landowner are not responsible for verifying that the Hunter has the necessary permits, follows legal hunting practices, or adheres to state and federal laws.
• If the Hunter violates any hunting laws, they assume full responsibility for any legal or financial consequences, and Field General and the landowner shall bear no liability for such violations.

4. Conduct and Compliance

• The Hunter must respect the landowner’s property, including gates, fences, crops, livestock, farm equipment and other structures or items.
• Any violation of hunting laws, trespassing onto neighboring lands, or unsafe behavior may result in immediate termination of the booking without refund.
• The Hunter must leave the property as they found it, ensuring all trash, spent shells, and other debris are removed.

5. Indemnification

• The Hunter agrees to indemnify, defend, and hold harmless Field General, the landowner, and their representatives from any claims, damages, or liabilities arising from their use of the property, including but not limited to injuries, death, property damage, and legal fees. This indemnification applies regardless of the cause of the incident, including the negligence of any party.

6. Payments and Fees

• Hunter acknowledges that transactions are completed through Stripe, a third-party payment processing service.
• Hunter acknowledges that a 20% service fee is included in all transactions. This service fee is intended to support Field General with the following, but is not limited to: administrative fees, processing costs, and website maintenance.

7. Cancellation and Refunds

• Unpaid bookings are automatically terminated after 48 hours.
• Cancellations are subject to the refund policy determined by Landowner.
• No refunds will be granted for early departure or violation of these terms.

8. Dispute Resolution

• Any disputes arising from this agreement shall first be attempted to be resolved through informal negotiations. If unresolved, disputes will be subject to arbitration as outlined in Field General’s Terms of Service.

9. Acknowledgment

• By completing a booking, the Hunter acknowledges that they have read, understood, and agreed to these terms and that they fully assume all risks associated with the use of the property. The Hunter also agrees that Field General and the landowner bear no responsibility for any harm, injury, or loss that may occur during their use of the property. The Hunter further acknowledges that they are solely responsible for complying with all applicable hunting laws and that any legal infractions are their own responsibility.
